What pisses me off the most us how stupid game developers are getting. "OH. MY. GOSH. SOMEONE IS BASING A GAME OFF OF OURS?! WTF LAWSUIT."
Almost everything in the world works like that. People intentionally copy each other, or do so subconsciously. I read something once about how the brain complies all experiences/thoughts and we use all of that to make our decisions, without even realizing it. Now I don't know if that's true or not, but it would make sense.
I think calling the game "scrolls" and if it has more in common then just the mountains, yeah, it's worth looking into, but maybe not a lawsuit.Do or do not, there is no try.

Yeah, it really is.
Then again, Some of it makes sense. My one friend is having a company screw her over. They wont give her the disability funds she should get. That is not childish to sue, as they have tried to sort it out.
But over a game?
Over a GAME?

I used to threaten to sue people constantly lol, and I still hear 10yr olds telling people that.Do or do not, there is no try.

No thanks, these Company's already have god knows how many lawyers on retainers, they can afford fines like that, imagine how much these lawyers get paid.
The only things fines will affect are the individuals and smaller companies who can't afford such fines, and half the time the legal fees they face will be substantial regardless.
I'm not sure what their motive is, maybe they geniunely think it'll hurt their bottom line, it's up to the judge to see if it has any merit.

A lot of people don't get what's actually happening here, mojang is trying to get a trademark on the word "scrolls", meaning that if Bethesda were to name any more of their games "the elder scrolls", mojang would have the right to sue them, as, until now, mojang has been the only source of info, o course he's going to make Bethesda look like the bad guy

If the true argument is the name, then why is Bethesda going into court with the battle over mountains?? They could be countersued by the government because they featured the rockies in their videogame...U see what im saying? Like their argument holds no weight, If they went in to defend their name then thats understandable but to have a counter sue for mountains?? Like comeon...

They can't copyright the word scrolls because it is a "common" english language word. In the same way that Apple can't copyright the word apple itself.
What they can do is challenge it's use based on context. If I were to start building computers and call them say Big Apple Computers and start selling them with an apple for my logo (even though it didn't look like THE Apple logo) then I'm sure I would not only get sued but I would lose the suit in record time.
The same goes for software. Bethesda has The Elder Scrolls as a software franchise. Mojang has created a game they call Scrolls. So while they can't sue that they own the word scrolls, what they will be going to court over is the idea that someone could get mixed up that there is another game with Scrolls in the title causing loss of sales based on brand confusion (also noting that Scrolls was to come out the same day as Skyrim). The trouble is, since the titles are not the same, the genre of the game is not the same, the logos aren't even remotely similar... Can they even begin to hope for a favorable outcome on their part? No. BUT... This lawsuit is generating publicity. So could they get the same amount of publicity throwing money into marketing as they can by suing Mojang on a dollar per return basis? Probably not.
I think they know they won't win this. But there's no such thing as bad publicity. If the Skyrim sales go up even a fraction of a percent on release because of the lawsuit because people are curious about it... The lawsuit paid for itself.
