Over blown in my opinion. All the bugs and crashes didn't stop me from clocking 80+ hours in the first two weeks.

That doesnt change anything though. Many people dont slip walking thru a puddle but stores get their ass handed to them all the time by those that do.

Highly unlikely. They won't lose and I bet you this doesn't even see a day in court. However if it does EA is a huge company able to employ the best lawyers. Chances are the jury would be easily swayed by them in EAs favor.

Gearbox didn't sweat their class action, and there game was broken and false advertisement.

You have to deliver what you promised. If EA/DICE promised a piece of unfinished crap that they'll have to work hard to fix over time then they don't have anything to worry about I suppose. If on the other hand it can be proven that they promised something for $ and didn't deliver ... well then, maybe they should be held accountable.
