It's "somewhat" true by the way I read it... Or "mostly" true...
For instance, you can use trademarked names like H&K and such and their guns distinctive likenesses in games. And while it's unlikely that you'll get an attorney on your ass for doing so under normal circumstances, some may still do so. Rockstar was sued for having a strip club logo or somesuch in one of the GTA games and it was ruled that a video game was labeled as "free expression" and thus they could use the trademark (or a likeness similar to it). However, if the use of that trademark could cause sufficient confusion to the public regarding that brand then there may be grounds for a lawsuit.
So if DayZ wanted to have cans of VanKamp's frank & beans in their game they would likely be able to get away with it if they wanted to. That wouldn't stop a rabid trademark lawyer from bringing suit but they would LIKELY lose.
If you created a game called Smith & Wesson's M&P Murder Nightmare where you wandered around with M&P pistols and AR's killing a bunch of babies and puppies... They could probably have you shut down in about the amount of time it takes you to spit-take.
That IS of course my understanding of it based on what I've read prior regarding the Rock Star lawsuit.
