    Kenneth Elrod Lawsuit: Family Of Man Slain By Off-Duty Chicago Cop Awarded $1.35 Million Settlement

    "A jury late last week awarded a $1.35 million settlement to the family of a man who, in 2006, was fatally shot by an off-duty Chicago police officer."

    Precisely whats wrong with our justice system. Guy gets into fight, goes home and gets gun, returns to fight and opens fire, off duty cops kills him, and city loses 1.35 million because he used excessive bullets. LOL WTF?

    I didnt see in it how excesive use of bullets would give that award. Did i miss something in it? My point was simple. Dead is dead and if he didnt take first shot i dont see how they should have recieved anything.

    Plaintiff Maria Elrod, as administrator of the estate of Kenneth Elrod, and plaintiff Cristina Centera, on her own behalf and as administrator of the estate of Demetri Centera (collectively, "Plaintiffs") filed separate complaints pursuant to 42 U.S.C. § 1983 against defendants City of Chicago ("the City") and individual police officer Edward Yerke. The lawsuits allege that on the same night, April 7, 2006, Yerke beat up Kenneth Elrod and shot and killed Demetri Centera. (Centera Comp. ¶¶ 6-8; Elrod Compl. ¶¶ 5-8.) Centera's lawsuit was reassigned to District Judge Filip as related to Elrod's. [Dkt 42.] In addition to claims under state law, both Plaintiffs bring § 1983 claims of excessive force against Yerke, and claims against the City pursuant to Monell v. Department of Social Servs. of City of New York, 436 U.S. 658 (1978), alleging that certain customs, policies, and practices of the City caused the alleged constitutional violations.
    It would appear that the attorney for Elrod proved to a jury of his peers that the above was true to some degree. I beleive its along the lines of Off Duty Police officers, and the state of illinois. (i could be wrong)

    Yeah i read that. I still dont get the excessive gunshots part. Maybe it came down to who started the fight to begin with. I just see it making sense that the guy left and returned with a weapon then won his family won a lawsuit.
