Easiest way to get the legal issues out of the way are to have it included as part of the lease. While they probably can't just add it to the current lease, whenever it comes time for a tenant to renew their lease it would just be a part of the new lease. As for the cost of the initial testing....since there's not a lot of information they'd be looking for they could probably get by with one of the "cheap" tests, which from a quick internet search can run as low as $100 (not counting the do-it-yourself tests that I saw advertised for $79). One thing the complex could do to not be guaranteed to eat the cost themselves, is to have the test done in a security deposit-type way. In other words, the tenant would pay for the initial test, but were the tenant to clean up after their animal and not violate that clause of the lease, at the end of the lease the complex would reimburse the tenant for the charge. If, however, the tenant DID violate that clause of the lease, not only would they lose that reimbursement, but they would be subject to whatever fining system they agreed to when they signed the lease, likely including the cost of the test that caught them.
Of course, this is all purely hypothetical and conjecture, but that's one way the system could work.
