Jameis Winston not charged with rape

I was going to put this in the sports section, but wasn't sure how heated it might get.

Jameis Winston not charged after sexual assault investigation - ESPN

TLDR - He says it was consensual, and she says it was rape. His semen was present in her, but so was the semen of another male, her boyfriend. Her blood alcohol level was .04, and she has a hard time remembering much of what happened.

The alleged victim's attorney says this will discourage other rape victims from coming forward. I see the possibility of this, but I also see the potential of this being, "Oh shit, I got drunk and had sex with a guy that is not my boyfriend, now what?" My guess is there are only 2 people who know the truth, but if I were a juror I would say not guilty.

Unless there were physical violence that could be traced back to him, he should walk.

Forgot to mention that, but when they did the rape kit test the doctor said there were no signs of trauma, or whatever term they use that would lead them to think it was rape. Sounds like the only thing that points to it being rape is her testimony.

I do think he should be punished by the team for his poor conduct. Banging a girl who was that drunk is not exactly the kind of person/player I'd want as a coach leading my team as quarterback.

I think if there were punishments for having sex with drunk girls then all college campuses would be female only.

He's the leader of the team. He's banging the drunk girlfriend of one of his friends...who just finished banging her boyfriend.

I understand her pain though. I've known 3 women, one of whom I dated a while back, that were raped. Two were drunk, but the one I dated was slipped a "rufie" (sp?). She barely remembers any of it, except flashes. It was traumatizing to say the least, and the guy was a male nurse.

At the same time, you can imagine that if you're with someone and you sleep with someone else while under the influence, some people might use rape as a rationale to keep their significant other from leaving. I'm not saying that's the case here, and I certainly know it could go either way. But this is one of those times when the guy should walk in the absence of corroborating data to support her case.
