The problem with it isn't public photography. It's the ones that run around like they know what they are talking about and BLATANTLY wrong about it. And while I agree that some of them are in the right... going out and provoking cops just to try to get a rise out of them and get a viral youtube video is a) just asking for an asswhupping and b) stupid. It doesn't HELP people who are in the right. Like that one cop in the video said "oh I see you've been watching youtube". Yeah... unfortunately he had.
If you are in a car and are asked to see your drivers license... YOU SHOW IT. That's the law. It's your license to drive, which is a privilege not a right, and is required to operate a car. Whether a random stop like they had set up is legal or not is a state by state thing until the feds rule on it (which probably won't happen soon) so... if stopped... show your license, registration, and insurance.

Illinois:
(725 ILCS 5/107-14) (from Ch. 38, par. 107-14)
Sec. 107-14. Temporary questioning without arrest. A peace officer, after having identified himself as a peace officer, may stop any person in a public place for a reasonable period of time when the officer reasonably infers from the circumstances that the person is committing, is about to commit or has committed an offense as defined in Section 102-15 of this Code, and may demand the name and address of the person and an explanation of his actions. Such detention and temporary questioning will be conducted in the vicinity of where the person was stopped.
As I stated previously, a federal supreme court ruling has stated that you only have to state your name. And while you can see it also states that the officer may stop someone when the officer reasonably infers from the circumstances ... offense has been, is being, or will be committed, you aren't psychic and the cop can say whatever he wants in front of a judge, so don't assume you can just say no you aren't stating your name either because you weren't doing anything wrong. Maybe the cop thought you were getting ready to jaywalk or litter.
It also states you are to explain your actions... but I do not know if you have to do that or not, thus... I'd probably explain myself. There may be precedent set in that regard as well though.Last edited by Kanati; 04-10-14 at 06:44 PM.
