The fence around an entire man made lake that will have a better chance of keeping a 2 year old out of the water....I will insert the argument here that was used in the child getting in the gorilla enclosure. You would think a gorilla enclosure, being MUCH smaller than a man made lake could keep a child out. People's argument was "Children get away from you, it happens" In this situation the parents KNOWINGLY let their child wade in the water...some reports say the father was nearby wading WITH the child. I realize that reading English may not be a requirement to book a room at Disney but this family is from Nebraska. I will be the asshat here and simply say this is Darwinism at its best. There is now one less male in the world that will eventually create a child that will disregard a warning sign. My real regret is that the 2 year old wasn't spared and instead the father was the one taken by the gator. That would have been justice. But yes, you are correct, Disney will pay this family an insane amount of money for their loss to avoid litigation.

I get all that. So don't build next to a lake, or don't build in Florida. You make it sound like the universe forces hotels to be next to lakes. Disney terra-forms everything. They don't build small-scale. They sculpt the landscape to fit their eco-architect design.
I don't think that Disney willfully caused a death. I think they grossly miscalculated some odds.
Completely true. But if that beach had been fenced off and the family had cut a hole in the fence, how do you think that would have affected the civil suit?
The sign said "No Swimming". Was anyone swimming?

In my world - among my fellow hikers - "on the trail" is where you are when you're out in the wilderness. Sometimes we are on an actual trail. Sometimes we are bushwhacking. Sometimes we're in places that require you to be on the marked trail - for example, some high-altitude alpine environments.
Sometimes we're in a canoe or a kayak. When we get back, and someone asks where we were, sometimes the answer is "on the trail." Sometimes the answer is "canoeing". Never is the answer "on a lake", even though that is a much better literal description.
That said, I know that my world isn't the whole world. I have room in my brain for the possibility that other people will use other phrases to describe similar things.
I haven't lived all over the country. I think I've only lived in 9 states. But I have been a lifeguard. At the time, if a place was open for the season but didn't have a lifeguard that day or that afternoon (for whatever reason), they might post a sign that said "No Swimming - Lifeguard Not On Duty", or some other variation. For a place that had decided not to open for public swimming that year (for example, at a private lake that adjoined a golf club), they might post a sign that said:
No Swimming
I'm sure it's different in different places.

You wouln't need to fence in the entire lake.....just the part Disney turned into a beach. If folks had to walk an extra 100 yards, and enter the water in a grassy (or otherwise un-beached)/ weedy / rocky area, folks would be much less likely to do so, DG is right when he says that fences won't keep all of the people out of areas they shouldn't be in, but a fence would have most likely worked here. I HIGHLY doubt that this guy would have walked around a barrier of any type to allow his son to splash in the water a little bit.
As for different terminology in different parts of the country, folks in Wisconsin call drinking fountains "bubblers". There is no sane explanation as to why.
