Court of appeals can do whatever they want. Until they rule, its not going to change. I agree with them that for extended period of time would be a wrong. Its like a terry stop in police (Terry v. Ohio) we can stop you on REASONABLE suspicious, not probable cause, frisk you, and ask you BRIEF questions...with out probable cause, we can not hold you any longer. Same thing with the GPS, they are tracking you based on a reasonable suspicion, not propable cause, wich is the standard of proof needed to secure a warrent.
And consultant, it is NOT illegal to tail someone, which is what makes this ok. But if you were to tell someone for lets say....3 weeks, then it becomes harrasment. Thats why they say EXTENDED periods of time is wrong
You have got to love criminal law, because there is ALWAYS a way around it...
