If they are captured on foriegn soil the rule until lately has always been they go before a military tribunal because thats what the UN stated was the fair way to go. Of which that tribunal could be held anywhere in the world.
Seeing as the bill of rights is a contract between the government and the citizens it doesn't take much thought to figure out that if you are not governed by the US then those rules do not apply to you. There has already been a group formed and declarations made to address those of foriegn nationality being confronted by those of a different nation. Its called the United Nations and they have all their own rules on how to play nice with others.

This is precisely why military tribunals are necessary and yet another demonstration of the incompetence of this administration.

He said the Military Commission Rules of Evidence preclude or restrict the use of "statements obtained by torture or cruel, inhuman, or degrading treatment," and evidence derived therefrom, and could require exclusion of Abebe's testimony.
