Nope. You can get a dui on just about anything. The best part is you cant drive home because you'll get a dui but you cant walk home because you'll get a drunk in public. Either way your fucked.

With good cause, too. I can't tell you how many times I've seen a horse wrapped around a tree or lamp post, due to a drunk horse-operator.

Saw a cops episode where a dude got a DUI on a riding mower, another where the cops made an old man pour his beer out while driving a golf cart home from church. Then they called his wife on him.

The real question is... could they charge you if you were sober and the horse was drunk

Well, if it's too drunk to consent to be ridden, then that's a different story.

If your riding a horse in the countryside, then don't see an issue. But if you are riding it down the street, then I see no issue with it, I wouldn't trust a drunk person to ride a horse in the middle of the city without falling off into traffic or something.
