well, technically it is evidence, and as he is acting as his own defense, he has a right to view the evidence. Im guessing that he wont win the case, even if he did have a lawyer.

Not really sure what you could change the legal proceedings to change this, unless you make it in child pornography cases that video and photo evidence cannot be seen by anyone, and just be certified to have child porn on it by a neutral party outside of court.

I was just talking with a Magistrate Judge on Thursday, and she brought up something just like this. She said a lot of people awaiting trial for child porn request copies of the evidence. *shrugs* Pretty gross if you ask me, but there are legitimate reasons to request the pics.

Sure I could see a legitimate reasoning being trying to despute the age of the persons involved or ... lets say this person is one of those people that gets arrested for taking a pic of their nude infant in the bubble bath etc or other reasons.

Not everyone arrested for a crime is guilty of the worst case scenario where it is 5 yr olds or whatever.

And Nightmare that neutral 3rd party? It is called the Judge. That is his/her job to be the neutral unbiased 3rd party to insure the rules of the court are followed so that the defendant gets a fair trial decided by the jury. They are supposed to be on no ones side. They are the blindfolded statue in the Justice is blind thing
