Thread: dealing with insurance COs

When your ins co says pay you 500 they will say we already paid 1300. At that point one of them will want some money back. Just a guess.

Cash the checks, period, before they cancel them. Get your car fixed within the best means possible, and hang on to the rest of the money for a while. If after 60 days nothing comes of it, I would say you are in the clear.

I would not contact them any further for the matter. Wait to see if they contact you.

I guess the question is what are you entitled to contractually compared to what can you get away with? Contractually/legally you can't be paid twice for the same event. If the accident was the other driver's fault then his insurance company should pay 100% of the cost of the repairs plus anything they pay you for your "injuries". Your insurance company shouldn't pay anything since it was his fault. Contractually/legally your insurance company can ask for the money back. The million dollar question is will they ever figure it out, and if they do what do you do if all of the money is spent, and you have no other way to come up with $1500?

Insurance companies keep records of every claim. Those records are shared between insurance companies also. If you have a bunch of claims with company A when you apply at company B they will know it. Will they catch it? I would say it is probably 60/40 yes/no. All that being said I would probably cash both checks, and if either company asks for money back just play dumb and say you did what they told you since they told you to contact his insurance company.

yeah i'm not spending the money less i have to. i figure ethier way someone owes me 1800. (going by my insurances estimate) and my company didnt even mail me a check.
they asked me you want us to come look at your truck give you an estimate i say sure couldnt hurt (having another estimate ) so they come out guy drives up in his progressive issued suv looks at stuff takes pics goes to his suv.

talks on the phone for half an hour prints me a check from his suv. that i never asked for tells me i could get my 500$ back (the deductable they took out of my check) from his company week or 2 later his company calls me we are sending you a check for 1100 and some change so if they ask for that back they will get it minus the 500$ for my deductable its all very confusing instead of fighting for me they would rather just pay me themselves so i guess i'm just gonna wait as long as i cant and spend no more then the 1800 i'm owed from one of these companies
