Those people do a lot of interpreting...and it's really loose interpretations...

You know what the issue is.... The majority of the " members and staff " here, are members and staff there. People get/got comfortable. They get in trouble and got a suspension of privilage. They didn't get banned. So it isn't just that they are stating their frustrations. It is that they can take a pot shot at someone there, here, with minimal issues at the moment. I am not saying this is a bad thing. People are here and there AT THEIR OWN WILL. Don't go back... There is no need to go there to post crap to see if you got banned. LOG OUT AND BE DONE. Doing shit like that is a SCREAM for attention.

If you get banned, you don't come back. I never liked that people used the word ban. Soo harsh .... and that is what it is, a harsh word that is misused. But i say again. If it is better on the other side of the fence, then don't crawl back over.

I don't see much wrong over there except for the occasional issue. But in most cases, they come from people who have gotten comfortable and bitch that " it shouldn't have happened to me" ... Don't give me that shit. If a governor is caught smokin crack, he gets charged like everyone else and there is a penalty involved. I mean really .... You all know, NO ONE is above the rules.

I come here cause this is ALAN's Place, and i enjoy some of the people here. I am at the " place down the" oh fuck that .... I am at Gaming Forums because i enjoy helping those i can help. And doing what i do.

I mod there, and I know for a fact I just cant do what I want. I never have been able to and I dont see that I will ever be able to.

Seriously I think most of you need to cool down a bit and figuratively speaking walk away from this. Not just on a moral basis which I'll try to stay away from talking about here since how you decide that's largely your own business, but because it can be considered in some legal jurisdictions to be a violation of certain agreements you have with Ziff Davis.

Being banned, even if for a reason that you might consider silly could easily be considered connected with your use of the service in some jurisdictions.

In that sort of context indemnification is generally considered a contractual promise to protect the other party from financial loss, since companies tend to trade largely on their reputation as well as their quality of service it could be said that by criticising them they are causing them financial harm and thus are in breach of the agreement you have with them.

I don't think most of you would get sued by Ziff Davis, though obviously that's just my opinion, but at the same time I think having this sort of thing here could put this forum and its members in the way of a lot of harm somewhere down the line.

Obviously I can't make you do anything, you all have to decide what's right for you, and I don't know a lot about the law as it is applied in New York so I can't say quite how far such an interpretation would hold up in the courts there. You should as with anything concerning the law, take anything anyone says with a pinch of salt, read through the agreements that govern your use of things and come to your own conclusions.

But I've worked for quite a few companies in the past and I can't think of very many of them who just let this sort of thing slide forever.
