DWI!
Here is the story..
On August 13th 2007, I was leaving a local bar around 11:15 PM at night.. This day happens to be a monday... I went to have a bite to eat at my old job around 6:30 Pm. see an old friend of mine I havent seen in ages start chatting it up and we decide to go to another bar. One that I hate i might add. (even before this all happened.) So I reluctantly decide to go up there since I haven't seen him in awhile. We go up there hang out have a few beers, I have to workin the morning around 6:30am when I get up for a long commute into downtown Houston. So i leave the bar and turn on to a road called sawdust.. the speed limit on it is a mere 30mph.. But I turn on to it going around 40ish.. my house is 1.5 miles down the road and a damn statetrooper pulls me over and immediately asks me to get out of the car.. At this point im like "what the hell? i've never been asked to get out of a car right away." He said I was "speeding" and that I was obviously coming from the bar down the road he said Rookies or Wiseguys.. I said in response, " How would you know this unless you were camping the parking lot? I could be coming from wendy's or whataburger for all you know." That didn't set to well with him so he gets pretty frustered.. this is a younger cop i'd say around 26 - 28.. Wolf was his name.. I kinda chuckled when I was his name tag.. He said I need you to blow here into this device. I said no way jose, I don't trust those things. I said take me to the hospital and lets go get some blood drawn. He looked at me like I was nuts. He said are you refusing to do a breathalizer test? I said I'm refusing the breathalizer, but not refusing a blood test. Now lets go. He said thats not my choice anymore.. I was like what? show me where it says that. so he whips out this paper that says i'm refusing to blow blah blah blah.. I signed it.. Then he asks me to do some sobriety tests.. Told him sure why not.. So i do 3 tests. Apparently I failed 2/3.. So he hauls me off to jail.
Anyhow 12 hours later i get out bailed out.. Well make a really long story short. my video wasn't the greatest, so I decided not to take it to trail and just go with a straight conviction. but some of the fee's associated with it are as follow.
Lawyer fee: $2500 (if went to trial would be another $2000)
Court Costs: $394
Fine : $500
Occupational License: $197
DPS Fee: $10
DPS Renewl Fee: $1,000 for 3 years ($3,000) If I want to keep my license after everything is over. (very unconstitutional.
Anyhow when it's all said and done first dwi offense equals = $ 6601
that almost makes me want to puke..
anyhow lesson learned.. DO NOT DRINK AND DRIVE. YOU WILL GET A**L RAPED BY Fines !!

Ummm... the lesson here is don't ever refuse to take a sobriety test. Even if you know you are going to fail.
See... if you take it and you are say... .03 over the limit you are prosecuted for that amount over. Sort of like the difference in being 10 mph over the speed limit and 40 over. If you refuse then the Law assumes the worst and charges you with the maximum penalty.
At least that is the way it works in the Midwest...

I've got friends that say always refuse it. One of my closest friends got off with a ticket for not using his blinker when it was all over with. Cost him about the same amount of money but no DWI on his record.
And by the way I agree it is easier if you just don't do it.

If you are ever pulled over never admit to having anything to drink. Not even 1. If you admit to 1 you will get field sobriety test and it does not matter if you pass or fail you will get breathalyzer. Your fines didn't mention the cost of insurance hike which is triple the price for 3 years and double the price for 2 years after that.

Implied consent law.
Some states have laws on the books that state if you have a licence for a motor vehicle you are consenting to have a breath, blood, or urine test *any* time the Law wants one.

Drunk driving is a huge offense in Texas. That sucks about paying all the fee's but let be a lesson learned.
My sister-in-law was in a wreck with my 3 nephews a few days ago. Everyone is ok but the car was totalled. A drunk driver hit her and his ass had to go to the hospital. I'm pretty sure that the judical system is gonna throw the book at him.

That shit will stay with you until the day you die. I got popped under similar circumstances almost twnty years ago. Old bud from high school called me and wanted to hit a bar . . .I didn't want to go . . . gave in to his badgering . .. .blammo. OUIL.
To this day every professional license (three total) that I have obtained required that I explain that event. I wish that I had spent the time at home like I wanted.

Bottom line..my lawyer said this verbatim. If you ever get pulled over and had drinks, sit on the curb and just say you refuse EVERYTHING and want to talk to a lawyer.. Yes you will go to jail, yes you will be charged with a dwi, then you go to court, you want to fight it. It goes to trial, they have no evidence for a conviction so your case basically gets thrown out.. That is what I should have done. But me being dumb just sat there and argued with the cop. <- that way will still cost around 3 - 4k depending on your attorney however, you won't have a conviction on your record.
also, during the entire period of while that is going on you can drive because you havent been convicted of anything.
