read documents from the START of the civil war....it was STARTED over taxes....Southern states were making a SHITLOAD of money off of the farms and such and the north thought that since they made more money, they should pay more!
Southern states thought "hey, we're ALL states, we should ALL pay the same"
The civil war is presented as a "glorious fight to free the slaves" mainly because that was a secondary issue that took the forefront for political support.
When Lincoln issued the Emancipation Proclamation, he was freeing slaves that technically, were in another country at the time....yeeeeah...
Also, the overall quality of life for African American's GREATLY decreased after the civil war.
before, they were treated like property, keep em fed and happy, and they're more productive, therefore more bang for your buck. Afterward, sure they were receiving a salary, but it was less than they were receiving as far as food and shelter beforehand.
The north's wanted to free them, but were still HIGHLY racist overall.

It's interesting to see how this thread is starting to devolve away from the issue at hand. Roughly stated, the issue is is capital punishment for child rape Constitutional under the 8th Amendment (within the Bill of Rights) when the rape did not intend or result in the death of the child?
Everyone has raised good questions, but no one seems to care about the answers. It appears that they just like to hear themselves talk.
Remember that our teamplay and communication have practical applications.
In this situation the Supreme Court provided 59 pages of pro and con explanations for their votes. They fought amongst themselves, maybe even left work hating one another, so that our nation could take another small step to being better. And it appears that you guys ignored their efforts and writings despite them occurring under the rules of the Constitution and Bill of Rights that you purport to support. Ironic, don't you think?
What could be more ironic is that the man that was sentenced to death was the victim's dad. I don't know about you all, but I look to the future. I would rather leave open an opportunity for the dad and daughter to have a good cry together when they are in old age than for the daughter to cry alone and never have any chance in hell of understanding what or why her father did what he did. Not knowing is horrible, horrible, horrible in my book.

Capital punishment for heinous crimes shouldn't be an issue handled by the federal government (As far as freely changing any state law they see fit). Leave it up to the state in question to decide. It's all about the state's rights. There are at least two obvious arguments to be made here. The first concerning whether or not the death penalty is appropriate for child rape and the second, concerning whether or not the federal government was overstepping boundaries by deciding to change the law in a state that made a decision for itself.
I personally feel that in some cases, the death penalty for child rape would be appropriate and proportionate to the crime; others not, but leave that up to the state. I also feel that in this instance, it was not necessary for the federal government to come in and change a state law. The law in place wasn't ridiculous in nature nor was it some obviously flawed law that needed to have federal government intervention.
Believe me, Louisiana doesn't have courtrooms in barns with judges sitting up there with shotguns in their hands screaming "Put the rapist to death" all day every day. Louisiana simply had a law that allowed them to impose the death penalty should they see fit.
You can throw all the political mumbo jumbo at me that you want, but the fact is the federal government sometimes sticks their nose where it doesn't belong and changes things that really they shouldn't be changing. Let the states decide on their own laws and so long as they aren't ridiculously written, the feds should leave it be. On that note, I also believe that the decision of one state should not be grounds for changing a law in another, that's the whole point of having states.

Well we're closer to being good citizens. At least Gumby has big enough balls to say "I feel" before he ignores the writing of our Supreme Court.
Anyone else here have big enough balls to disagree in this forum? Or is Gumby our last patriot?
