    Auto Insurance Question

    I have been with the same insurance company now since I could drive (roughly 8 years, US Agencies). I was involved in an accident in 2004 where an individual hit me from the side. He was at fault, a police report was produced saying he was at fault, etc... I just got my renewal letter in from my insurance company and they have a section where it lists included and excluded drivers in my household. Under my name it had my accident listed, gave the date of the accident and other general information. I noticed though, that it had me listed as at fault. So for the last 6 years (accident was in 2004) I have been on the record for being at fault, thus I would imagine this raised my insurance premiums for the entire time. This particular insurance company only goes back 3 years, so this only affected me from 2004 to 2007, but it still blows.

    My question is, is it reasonable to think I could be credited for all the extra money I paid due to the incorrect driving record, assuming I can fix the issue?

    Insurance is legal robbery. Good luck getting your money back. The fault thing also depends on the state you live in.

    I've generally had very little problems in dealing with US Agencies, so I'm hopeful something can be resolved, if not, I guess I'll still be on my way. I live in Louisiana btw.

    had the samething rock your accident should drop off your license after three years is probably why they only go back that far on driving record.They are using that to rate your insurance premiums which is and was bullshit. I too was hit in the side on private property no police report as they will not go on private property to write one but the other driver knew he was in the wrong and stated so as he ran a stop sign in a parking lot of a store. But still the insurance company raised my rates for three years after.

    That blows. I'm hoping they could at least credit my account or something, since I was paying them extra money for those years when I shouldn't have. I've never been in an accident where I was at fault, so hopefully that plays in my favor.

    Get a copy of the police report send it to the saying, "WTF do you mean I was at fault?!?!?!" In more professional words of course. I doubt it will work, but its worth a shot.

    I don't know about your insurance company, but I have had 2 accidents about 10 years apart and my rates didn't change at all. I have a friend at USAA that said it has to be so many accidents in a certain period to affect the rates.

    Yours might be different. Insurance companies do give refunds. For the first 2 years I was married my insurance had me listed as single. When they did a routine call to verify information I told them they had it wrong when even though I called to change it. On the phone without my submitting any proof except telling them the date they cut me a check. I was owed back around $1500.

    Are you sure your rates went up? The entry on your policy report may be wrong, but did you see your rates actually go up from before the accident? I would check into this before I got too belligerent with your insurance company. Call your agent first, and check with them, and if they find out your rates were raised because of the error, then raise holy hell.
