Do we charge the owner of the gun shop for murder? No it's the damn idiot's fault for the killing. Same with the drugs. I go into a diner and order a steak rare, I die because of my choice in the cooking of the steak, do you charge the cook for homicide? No same with the drugs.
If those others were operating illegally then yes they could be charged the same way. If the gun dealer did was not a licensed operation and didn't follow appropriate back ground checks... If the diner is already in violation of health code and serving customers ever after getting a cease and desist order I could very well see that happening.

its all about operating outside the law to begin with.
Eh I dunno bro. I just think that there is no way a homicide charge can be pinned on these dealers. It's the guys who bought the drugs fault. In no way can you tie in a homicide charge for drug dealing. If the dealers shot the guys for not paying or some shit, then that is a different story.

I would actually like to see them make this stick. Of course it's not going to happen. They cant even get those that are known to break laws with evidence convicted all of the time. Good luck though just another piece of shit that should be in jail to begin with.

I'd argue it that if the dealers had not been illegally selling drugs to begin with, the guys would not have died (though technically someone else would have been selling it, but still).

Some reason i see them pleading down to a lesser charge (or getting some charges dropped) in exchange for giving up information, but could be wrong *shrugs*

The act of them selling them the drugs did not kill the guys though, the guys ingesting the drugs themselves did.

If I hand you a knife and you stab yourself, it is not my fault.

If the people selling it were following the law though, the guys wouldn't have died (because they'd have nothing to ingest). Handing me a knife isn't breaking the law (unless i said i was going to use it to kill someone, or myself etc., then i think they technically could call that assisting).

I believe it would be similar to how they would say if you know a crime is going to happen and don't report it, you can be charged for it (forget exactly how it goes).

Not saying its right or wrong, just the way I see the argument for the case would go. My opinion is both are at fault, the dealers should be charged for possession but not the death.
