BLAH BLAH BLAH BULLSHIT. When a product is stepped up....EVGA refurbs the one you sent back IF IT NEEDS IT.....then sells it to Newegg or another 3rd party vendor at a ridiculous price, then they turn and sell it for a profit.
Evga doesnt just stick the new ones in a box....are you kidding me That'd be obvious on a scale large enough for the company to be shut down......DO YOU WORK FOR EVGA? BFG? Or are you mad cuz you gota wrinkled static bag?
As far as OC'ing and voiding warranty....WRONG again. Nowhere on evga's site under their "Void Warranty Policy" does it say OC'in voids warranty. I just stepped up from an 8800 gts 512 to a new 9800 gtx 512 for $7. I oc'd the SHIt out of my 8800 and they said nothing. You know why?? b/c they are going to sell it to newegg or another site to resell as a REFURB,...they go back in the cards bios and make sure it is set back to normal speeds....solder on a new capacitor or 2 then, poof, you have a refurb on newegg.com. etc.....
How do I know this It's called calling evga and asking them yourself.......while i was on teh phone with the guy, asking what i need to do to finalize my step up, i asked him that question, "So where's my 8800 going?" And thats the answer i got.
Are you sure you didnt accidentally buy a refurb?
Bad mouthing evga is like bad mouthing my mamma. Its just wrong.
P.S. 687 peak fps in CS video stress test on max w/ the new 9800 on stock cpu and gpu speeds. :9

totally white...i get 100-150 in cod on very high settings....but when i turn antistropic on past 2x...like 4x or 8x....drops down to 60-90. Ill be back in full swing eventually...still coping with the recent bullshit, working out some anger issues (surprise!), still trying to get promoted @ work etc..... ill hop in tonight if theres people on.

I play fine with 40 fps, and Tenrou somehow makes it by with 20 (I have no clue how). When you're back in full swing, make sure to stop by. We have enough regs to get a full 12 vs 12 thing going.
enf-Jesus its been like 12 minutes and you're already worried about stats?! :-P

Bad mouthing the entirely stepup program because your worried about getting used when you buy new and not being willing to return it for the correct product does not mean the system is bad, it means your going about being a consumer entirely incorrectly.
