Day of Deafeat: Source fps problems

okay so i've had problems keeping a 30+ fps in dod:s lately, now i would normally think its due to hardware (this is a laptop afterall) but for some reason even if i set my graphics settings in game to the lowest possible i can rarely get above 20fps, if i set them to the recommended i get the same, high? the same again. so basically i'm asking what would cause it to run at the same fps no matter the settings? i can't seem to get it to rise or drop and its making it unplayable when you get 15 fps.

does your laptop do any kind of clock throttling for battery life or heat reasons?
    Sleep, eat, conquer, meditate, repeat.
