Bypassing the release date in no way violates the TOS, you can check if you don't believe me. The Community Manager for BF3 already knows about this work around and has already stated the no one will be banned for it.

South Korea and Indonesia are the first to get it ,and the game is already officialy released there.....so u can do the IP adres trick if u want to play before release.
