NDIANAPOLIS (AP) — Indiana Gov. Mitch Daniels said Wednesday that he shares police groups' concerns that some people might misinterpret a new law that lays out when residents could be legally justified in using force against police officers.Daniels said he thought carefully before signing the bill Tuesday night. The legislation was passed by strong majorities in the House and Senate in response to public uproar after the state Supreme Court ruled last year that residents couldn't resist officers even during an illegal entry."Contrary to some impressions, the bill strengthens the protection of Indiana law enforcement officers by narrowing the situations in which someone would be justified in using force against them," Daniels said in a written statement. But, he added: "What is troubling to law enforcement officers, and to me, is the chance that citizens hearing reports of change will misunderstand what the law says."The law took immediate effect.The measure specifies that people are protected by the state's self-defense law if they reasonably believe force is necessary to protect themselves, someone else or their own property from unlawful actions by a public servant.
This is fucking ridiculous. Not that I think people should have the right to defend themselves, because I believe they do. The problem is, you wait until the first warrant service. Some drug dealing trash is going to be in his house, and the police are going to bust down the door, with a warrant, legally. This dude is going to be like "Hey, I can resist you now, you are in here illegally" and boom boom boom....someone is going to die.
Scenario number 2. You show up on a domestic violence call. Neighbor calls says she heard the woman screaming, and loud banging. You show up, and the husband is on the porch. He see's you, and goes inside. You knock on the door, he tells you to fuck off, while she is still in there crying. LEO's at this point DO HAVE THE RIGHT to enter your home for extingent circumstances to make sure the victim is ok. Bubba J isnt going to see it this way, and boom boom boom...someone is going to die...
This law is fucking stupid, and someone is going to needlessly die over it. Very disappointed in my state right now...

I would think you not understanding this law is ignorance. Everything you have said so far is the exact issue the gov discussed. This is not a free for all law. Its a law stating you may defend yourself against unlawful action even if its a cop doing it. Cops were never suppose to be above any law made. So all this did is restore the balance.

So your neighbor calls the police, says there is drug dealing going on in your house. I show up, knock on the door. I hear foot steps run, and a toilet flush...I kick down your door to stop you. Do you have the right to resist me? Am I acting unlawful?

"For those who don't take the time to read the law, it is going to be devastating for someone to think they have a right to resist if they only think an officer is acting illegally,"Show up and kick the door in without a warrant you are acting illegally. Show and kick the door down with a warrant you are acting legally.

Maybe someone had diarrhea.
I think you need to get close to the idea that the space which allows liberty to breath means you won't catch the bad guy every time. Maybe not even most of the time.
Sometimes the drugs get flushed. Sometimes the tip is bad. Sometimes the bad guys are one step ahead of you. That must be frustrating. Your job is hard, and I respect that. But if the objective was to make the job easier then we'd already be living in (more of) a police state.
I'm not saying I think this law is a good one. I have no convenient means to evaluate it. Maybe it's a shitty law.
But it doesn't surprise me that it came up.
