    The Oglala Sioux tribe filed a lawsuit in February against Anheuser-Busch and other brewers, as well as local retailers and distributors. I don’t know how the lawsuit will go, but I’m pretty sure a nationwide boycott of Budweiser would wake the company up.

    Breckenridge Brewery will take new brewery, jobs to East Coast - Denver Business Journal

    But even after the House Finance Committee backed the bill 13-0, large brewers and beer distributors complained that allowing a brewery making more than 60,000 barrels a year to operate restaurants and sell its own beer out of those locations would give it an unfair competitive advantage.

    The article says that the original motivation for Breckenridge to move some production east was that they were selling a lot in the east. Brewing in the East and in Colorado would lower transportation costs.

    That makes sense. What's the problem?

    I read it as they would rather stay in Colorado, but if they have to move some production out of state, East Coast would be more useful, business wise, than just moving next door to say, Nevada.

    The "at capacity" portion was what I was referring to. I read that as brewing capacity. Meaning any more, and they would have to give up their brewpub license.

    Ahh, possibly yes. I read it the other way - that their facility was at it's physical production (not legal) capacity. Don't know what local officials could have done about statutory capacity.

    Still, you're right. The passage is ambiguous.

    Ed Cerkovnik said without House Bill 1347 — a bill that passed a House committee unanimously but that House leaders will allow to die without a vote this week because of opposition that mounted to it from several industries — the brewery cannot hold a license to operate several brewpubs at the same time it holds a license to operate a manufacturing plant that produces more than 60,000 barrels a year in Colorado.

    It made 42,000 barrels in 2011 and, with added production capacity, is expected to hit 60,000 barrels at its main brewpub around the end of this year, he said.
