It has a lot to do with terrorism. The fear of terrorism is the latest boogeyman that the federal government has been using to justify removing our civil liberties.

I have no idea if this would be constitutional. It seems like it shouldn't be, but I'm not a lawyer.

Absent real evidence, I think it's too early to get all up in Leahy's grill over some bait-and-switch nonsense. It's clearly not what he wanted. He's one of the few who voted against extending the USA PATRIOT Act. Look at who else is on Judiciary - that can't be an easy crew.

I also don't know the guts of how these political fights go. Can the courts strike down a section of a law? If so, then adding a section that will obviously be found unconstitutional may be a tactic. I'm not saying I think that's what's going on (I have no idea). If someone knows more about it than I do, it'd be nice to hear from them.

I'd be happy if Congress or the Federal Courts affirmed our Fourth Amendment rights in an electronic world. It's been an issue for more than thirty years (and arguably more than 150).

In the mean time, most of us could do more to protect ourselves.

Aha! Great point. However someone will use the justification of terrorism if they haven't already to scare you into submission. Then if the bill does not pass into law magically out of then air boom! The media bombards you with a story about something terrible that happened that "could have been prevented if only that bill was passed into law". Next thing you know you allow a little bit of freedom to be taken away so that something you have better chances of having a heart attack than that happening to you can't happen to you.

I have no fear of this becoming law. Why not you ask? Simple, look how Obama repealed the Patriot Act so quickly after he was elected four years ago. Oh shit, we are all doomed.
