I'm pretty sure they'll say it'll be overturned, and go ahead and do it anyway. Then someone will need to dress up in a black cloak and a Guy Fawkes mask and kill Obama, or whoever the hell the president is at the time.

True, but I don't think the type of people they are trying use this tactic on are going to be worried about an infringement on their constitutional rights.... Just an assumption.
