Re: TSA in denial?
I would have to disagree with that in this case because a TSA issue has not made it the supreme court yet. I may have missed something because i cant read everything but every lawsuit i have seen TSA in court with in regards to this crap they have lost. Its only a matter of time before it ends up there though.
I will add that the supreme court has never oked random searchs for no reason for any law enfordement agency.Last edited by deathgodusmc; 03-06-11 at 11:13 AM.

Re: TSA in denial?
Of course they havnt, it would be unconstitutional to do so. What you fail to realize is, TSA only "searches" when they DO have a reason...its the degree of that reason that you either disagree with or do not understand. Terry v Ohio specifically outlined search and seizure laws based on reasonable suspicion for law enforcement...so the supreme court has Decided on the differences between what a "search" is and what a "frisk" is...which is what I was refering to. TSA's "frisks" of person after they walk throught he metal detector is the same as being frisked at a ball park, or football game, or concert. It's just TSA puts a little more effort in actually frisking someone. There is no law that says what you can and can not frisk, it simply states an "outer clothes pat down for contraband." (definition of a frisk).
TSA will "search" you if they have probable cause to believe you have something illegal. And I'm willing to bet, by them seeing something that a reasonable person would believe to be a weapon on an Xray image, that would be enough probable cause to open that bag, and search it. Just like every laptop bag at the airport gets searched...because they can not verify weather or not its a laptop..all they see is wires, and an electrical device.
The only time I have had a bag searched was when I was going to Las Vegas to perform with my band. In my carry on bag, I just brough 3 pedals with me for my guitar, along with my gutiar cables. That bag got searched because in the metal detector, it looked like little metal boxes, with cables connected to it. I did not complain one bit, and actually would of been pissed if they saw that in the metal detector, and just said "meh, seems ok to me" I gladly opened my bag, pulled the pedals out, explained what they were, and I was on my way
Don't yell at me...yell at your congrassman
