Even with training, it is still based on a human and with that comes human error. How often do officers re-test on using that tactic? It could just be me but I do not trust one person's judgement even with training. There is no proof in it. The cop could be having a terrible day. Or I may look like someone that effed his girlfriend. What is to stop him from saying I was going 6 over rather than the 4 I was actually going? I can't prove I wasn't and yet he can't prove I was.
I am also not a fan of the tactic of getting them to admit their speed. If you already have it on radar and do it just to seal it up, I am cool. However if your training was that good you wouldn't need to get the person to incriminate yourself.
It may just be me but I can't stand behind that, the fact that our justice system allows it, puts another black mark on an already bad looking list.
**By all this, some of you may think I am completely against police and all about speeding and breaking laws. That couldn't be farther from the truth. There are a few streets I may go 5mph over and on highways I typically keep it 5-8 over. Most cops either just ignore me or fly by me. 1 speeding ticket 10 years ago and one warning 4 years ago.I never miss. I simply fire warning shots.

Maybe i was a little confusing in what I was saying. Juding speed by eyes, is enough to pullsomeone over. Reasonable suspicion/good faith is the burden of proof for a traffic stop. To write the ticket, is also reasonable suspicion. This aint a murder trail death lol. You do not need beyond a reasonable doubt that you were spedding in your car for it to hold up in court. Thats why I said, i will always get the person to admit they were speeding anyways, just through my line of questioning.

On a serious note, it's the cop's word vs a person who potentially broke the law.

True, but the cop isn't going to just pull them over for no reason.. they have dash cams which can validate their claims. If the judge doesn't like it, he'll throw it out.

That and all the person has to do is what they normally do and play dumb. The days when cops could do these kinds of tactics are about completely over. I mean people are putting cams in their cars now because of how police abused their powers through the years. It just become something that is cheap to do. Well unless your a cop r with a government agency. They still think it takes thousands to do what a hundred dollar can do but we all know how well government agencies are at finances.

Nothing wrong with going a few miles under the speed limit unless you are impeding the flow of traffic. The only reason for writing tickets by law is to promote voluntary compliance of traffic laws anyway.

5-0 be trippin yo! In Canada they ding you with speeding tickets pretty crazily (compared to where I grew up). They have a law over here that's nuts, called the street racer law. 50km/h over the speed limit and they will fine you $10k impound your car and give you a 30day driving suspension. On the spot. That's right no trial, just a roadside judgement.
Canadian law makers must be fans of the dredd comics....
