Like Nuck said I don't know near enough about the whole case to speak intelligently, but if the officers felt they were in danger then it was justifiable. If there was no threat of danger sometimes it is better to live to fight another day.
I spent a few months in the Marfa/Fort Davis/Presidio, Texas area. Look it up on your favorite map site. Presidio is right on the border. There is a much different mood in terms of border worries there than even here in Fort Worth. It is one thing to sit hundreds, or even thousands, of miles away and tell someone what they should do, and another to sit within a stone's throw of the Rio Grande, and actually have to do it.

I don't need to seek help, remember, I'm 100% disabled.
My viewpoint on this story rests with the much ignored ongoing battle that was taking place around not only that time, but in recent months as well.
I'm not just talking about the battle of hide and seek. I'm talking, RPG's, heavy machine guns (.50 cal's and such), up to platoon sized elements conducting military operations up to, including, and OVER the border into this country. Part of the reason why military units have been getting deployed (National Guards AND Reserves) to supplement Border Patrol agents, not only with patrols and combat ops, but with construction of barriers, minefields, concertina wire, listening posts, observation posts, armor presence, UAV's, the list goes on and on and on.
I've only seen one "news" report about this, and that was on the Glen Beck program. He aired it one time and then there was nothing. Like it was some big secret.

I think the illegal alien did have a gun and may have even used it, but I don't remember the details.... I knew at the time, I thought there should have been no action taken on the border patrol agents trying to do their job to the best of their ability to protect our citizens from illegal aliens and intruders.
To stop all of this mess, they should put a sign on the border every 50ft that states:
Tresspassers will be Shot ! ! !
Do Not Enter ! ! !
No Tresspassing ! ! !
This is a Restricted Area ! ! !
This is a Protected Area, Anybody that enters, WILL BE SHOT and considered and Enemy of the United States of America and considered HOSTILE.
Tresspassers, will be SHOT ! ! !
DO NOT ENTER ! ! !
That ends all of the Tresspassing.
