    Hit & Run Advice

    Long story short, someone pulled out in front of me and we collided. Guy fled the scene of the accident but I got his license plate and filed a police report and he was arrested a few days later for no insurance and hit & run.

    So now I have the court date for this guy and I have the option to take it through my insurance or go to court to get restitution. There are a few ways I can go about this:

    1. Go through insurance. $250 deductible to get the car fixed (mainly aesthetic fixes) and a rental. Dont have to take time off work to go to court and wait for this guy to pay me.

    2. Go to court, hit this guy up with like a $1200 bill and see what happens. If not too sure of the process, and thats why this option leaves me with a few unanswered questions:
    - What happens if this guy doesnt show up to court? I know he will have a warrant out for his arrest, but I mean, what does that mean for me? Did I just waste a day off of work for this guy to run?
    - If the judge makes him foot the bill, how does that work? Does he just send me a check to my house (sounds really secure for retaliation prevention)?
    - What if he doesnt have the money to pay for it (which Im assuming he doesnt considering the fact that he doesnt even have basic car insurance)?

    3. Hunt this guy down bounty hunter style and shake him by the ankles until $1200 falls out of his pockets.

    Any help is greatly appreciated.

    I'm not sure what state you are from or how victims rights would work in your state but here is some general information about restitution.

    If a judge orders restitution the defendant will have to pay it in the amount stated by the court, in this case $1200. Usually the person will then pay the court who will then pay you. In the event that the person cannot afford to pay restituition the court usually requires that person to get a job and some if not all the earnings will go towards the payment of the restitution. If the person is incarcerated any earnings he or she may make while in the prison will be put towards the payment of that restitution.

    Like I said I'm not sure how it works in specific states but that si a general rule.

    If you do pay the deductible there may also be a chance that this guy will have to pay that.

    Really you should ask some kind of law professional in your area for a firm and clear answer.

    And I dont recommend #3

    It suck but sometimes just taking the insurance is best. Thats what you pay it for, so you dont have to hasstle with this shit.
    My wife was involved in a wreck last night... They plowed a cow on the highway, in the ambulance, he wasnt insured so... Yeah it sucked. She is ok and so is her partner.
    Thats the main thing, if you were alright, I would just take the insurance payment and move on. If you were injured then I would seek court action. Medical bills pile up.

    The safest bet, especially if your insurance covers a rental.

    If he skips court, you just get to waste the day. Are you sure you have to appear in court, though? You may be able to get away with just giving a sworn affidavit of the incident.

    For largish amounts (that still fall in small claims, like this one), the court will reimburse you (either immediately or on some kind of structured payment), and they will put a lien out on the guy, either his property or his wages, whichever the judge decides. Then he gets to repay the lien, or else lose his collateral.

    - What if he doesnt have the money to pay for it (which Im assuming he doesnt considering the fact that he doesnt even have basic car insurance)?
    If he doesn't repay the lien, the state takes the collateral and resells it at auction for whatever it gets, and takes any remainder after the lien in profit. If they garnish his wages instead, obviously he can't get out of repaying it.

    Thanks for the info Draco. Yeah #1 is the safest but why should I have to pay for being the responsible one? Fuck that. Im taking this guy to court. Ill call the officer to see if I can submit a sworn affidavit with nice little pictures.
