Extradite him and try him is the only answer. Just like anyone else, he gets his day in court. What is unfair about that?

The best explanation of Asperger's is that it's like trying to speak a foreign language that you don't know, or trying to speak to someone who doesn't speak your language, or whatever. My understanding is that it's just a social issue - the person with it is unable to communicate normally. Does that mean they wouldn't have the same grasp of ethics or "Hmm, maybe I shouldn't do this..." a normal person would? Maybe, but I don't think so.

At any rate, a trial is definitely the best way of doing things, I think. Besides, he's 43 - mild Autistic disorder or not, he's a fuckin adult.
