The US Congress has cleared the way for the government to continue to transfer inmates held at the Guantanamo camp in Cuba to the US but only to face trial.
The Senate vote, which follows approval in the House last week, clears one of the hurdles facing President Barack Obama as he seeks to close Guantanamo.
But the measure does not allow those convicted to be imprisoned in the US nor permit those cleared to stay.
Mr Obama has set a 22 January deadline for closing the detention centre.
More than 220 inmates are still held at the Guantanamo camp which was opened after the 11 September attacks.
The bill, which must now be signed into law by President Obama, was passed by 79 to 19 votes in the Senate as part of a larger budget bill for the Department of Homeland Security.
The US justice department has said that it intends to decide by mid-November which detainees will stand trial and what kind of court they will face.
Under the terms of the bill, Congress must be provided with a detailed assessment of the security risk involved before a detainee can be brought to the US.
The administration must also give 15 days' notice of any transfer.
Some Republicans have objected to plans to hold Guantanamo detainees in US prisons, arguing that they do not deserve the protections afforded under US law.
"There is too much at stake to grant the unprecedented benefit of our legal system's complex procedural safeguards to foreign nationals who were captured outside the United States during a time of war," said Senator Saxby Chambliss during the debate.
"Guantanamo must be closed because it's become a recruiting tool for al-Qaeda and other terrorist," Senator Dick Durbin said.
Under the bill, those convicted will not be able to serve their sentences in US prisons, and those cleared will not be allowed to stay, even when no other country will accept them.
That matter is to be decided by future legislation or by the Supreme Court - which has announced it will hear an appeal by a group of Chinese ethnic Uighurs, who are still being held at Guantanamo despite being deemed to pose no risk.
Their lawyers argue that they should be allowed to resettle in the US rather than China, where as ethnic Muslim Uighurs they would be subjected to persecution.

Some Republicans have objected to plans to hold Guantanamo detainees in US prisons, arguing that they do not deserve the protections afforded under US law.
All this talk about giving them their due process and all that other non-sense needs to stop. They are not entitled to our constitutional rights.
I'm quite sick of hearing about their rights being violated....because under our constitution, they have none.

I don't understand Why congress is so willing to set a New precident............ this has Never happened in the history of this country ! Can you imagine what would have happened to GI's in WWII if they were put on trial by the Nazi's ? I think the Japanese did it to a few airmen during WWII but I'm not sure. I think about 10 were put on trial for War Crimes after the Doolittle raid on Japan. But to extend constitutional rights to enemy combatants picked up on the battlefield has never happened before.

Oh noes let the fear mongering begin.
We are going to bring them on our soil oh no the horrors! They might plan an attack from their maximum security lockdown cell.
Its amazing we have the right to hold them in custody under our name but yet give them no rights. Do you think 100% of the inmates are guilty? Do you think maybe at least %10 were swept up in a raid or taken by mistake?
If you state the system has no flaws and each one of them are 100% guilty then you are full of hay. I
I say give them a fair trial and let justice handle the matter.
The courts decide their faith and not players from some online gaming forums.

Congress gives aid and comfort to the enemy
Players in online gaming forums vote for the politicians that select and confirm the judges on those courts.
Detainees are not citizens and do not deserve the full rights and protections that a citizen has.
They should be dealt with fairly but not given US citizenship just because they shot at us.
BTW: Fearmongering ?
Here is what happens when you deal with Islamic terrorists as common criminals...

All men are created equal. That doesn't mean all men in the U.S. are created equal and everyone else can fuck off, that means ALL men are created equal. Which means, yes, they have the same rights we do. The basic unalienable rights, ya know? The one's our forefathers wanted every man in the world to have, ya know? The "reason" America goes off and promotes Democracy across the globe, ya know? I'm pretty sure one of those said something about fair trials and blah blah blah. Damn dude, you guys are right though. They must not deserve a fair trial because they're less than us, right? They don't deserve to stand on our soil and be put in front of a judge so they can answer for their crimes (if any), right? I mean, fuck all those innocent guys sitting in that prison (you can't tell me all of them are guilty). I mean, I know they must want to get back to their families and all, but fuck em. Someone of the same color and same religion attacked our country so now NONE of them are allowed their basic human rights. AMIRITE OR AMIRITE?!?!?!
