Dam thats insane, I couldnt care less for cheating in highschool, but college is an entire different ballgame, Your paying to go to the universities, Some of them costs TONS of money to go to. Why on earth would you want/even think to cheat in college its just stupid. Personally i think that 1 kid who got the 60 should have been passed. That woulda been another slap to the face to everyone that cheated that the kid who did the worst passed becuase he didnt cheat nor did he study, but he made an effort.

Ya know, honestly, I think he's bluffing. I don't believe he (or anyone) has the slightest clue exactly who cheated. But to the same point, if you come forward and confess, you lose nothing, except 4 hours of your time to an ethics course. So either way, not worth the gamble to not confess.
On that note, I'd be pissed if I studied, got a good grade, and now have to retake the the mid term.

The best way I can think of that they could test or attempt to see who really cheated is to analyze past test data and see if it matches up. Most people have patterns in their scores so it should be fairly easy to tell who cheated and who didn't. Although smart people learn from their mistakes and will study harder to get a better grade the next time around. But I would agree that they probably don't know with the certainty that he is claiming who cheated on the midterm.
I would be pissed too if I got a good grade after studying hard for the exam just to have to retake it again. I'd try to fight it but I bet I'd loose.
I don't understand why people cheat anyways. You are only hurting yourself really by doing so and nothing good comes of it.

because sometimes you don't know the answer. of course, that's more of his shoulder kind of thing, not taking the test bank home.

This seems strange. If the questions came from a test bank that is easily accessible by the public, then at Stanford this would be a case of the faculty breaking the honor code. The honor code here also involves the faculty not making tests or testing environments that promote or make cheating easy.
For all I know, the students could have just been using the test bank as study material.
Of course... if it was a private test bank of the university, and students stole it and made copies of it, then that would be different.

I had a teacher blame me for cheating once... was barking up the wrong tree. The S.A.T. punks did it too, retake=OWNED.
