legal question
ok so i was helpin my sis in laws kid move and they were telling me her landlord went inside the home she was renting and cleaned her out. stealing anything he could get his hands on worth money xbox 360 with rockband a tv about 4 firearms .asked her is she called the cops and she said they told her it was a civil matter.
cause i guess her and the landlord didnt have a contract the contract is thru a housing program. but my question is no matter what shouldnt that count as theft? and since the total is probably well over 1k$ wouldnt that be grand theft? and if the cops dont intervene how would she go about getting him for theft or getting her property back besides taking law into her own hands.

yeah she was behinde some. and the housing pays like i think half her rent and she pays the other half. but its clear from a legal aide apointed to her that he had no business inside that house since she was paid till the end of the month. and this guy tore thru her house garbing whatever he cold even stole a fake x mas tree. the guns are registerd so i ponder if a call to the ATF would get things rolling or would they not deal with something this small ?

She can certainly take him to court. What is the comparison of the approximate value of the goods stolen vs. what she owed? They will certainly take that into consideration in a civil case. I personally think what he did was wrong but I also think it would be just as wrong for her to move out and move on while still owing him money. What was the expectation? Just move to the next rental until she got behind on them and the same thing happened? Not trying to judge here but there is accountability on both sides of this. Should we have no pity for the home owner because he may have money?
Why was she getting the government aide in the first place? Is she disabled? If not was it just because she could not find a job? For me personally, I would sell my 360 and my guns in order to pay my bills WHICH I OWE!
Probably none of the things you "want" to hear but with just a slight summary of what happened its all I got. There probably is way more to the story than I know and I hope she gets things worked out for the best.

The reason why I suggested a lawyer is ^ exactly. In that case you and your sis-in-law kid would need a lawyer.
As for rest of the comments, Nuckle is correct that the outcome would depend on the circumstances (who owed what to whom and the values owed)
In any event....it's your sis-in-law's kid. Surely between the three of you (kid, sis-in-law and you the helpful family member/uncle) arrangements could be made with an attorney on contingency or something along those lines. Barring a court case (likely civil) and some form of representation.....posting the questions here is fine but won't help your sis-in-law's kid in the slightest
