I think its always been legal, I've always seen shops promoting that they can jail break your phone. The problem is that it is against most phone companies policies and contracts. So if you jail break it, it voids your warranty and you'll have to pay full price for a new phone.

Re: ok so i have a iproblem
Yea so apple wanted to make it illegal. That way there couldn't be shops open to help people jailbreak their phones. But that doesn't mean that Apple has to change its policies in regards to their product. It's their product, they can have any policy they like. From the article "Apple spokeswoman Natalie Kerris said Apple won’t change its policy that voids iPhone warranties if a phone has been jailbroken." So basically the act of jail breaking your phone is legal but will still void your warranty.

Re: ok so i have a iproblem
Its the same thing with modding your xbox. I remember paying someone to mod my xbox to play burnt games and music. The act of doing this is not illegal, its my xbox I paid for it and can do whatever I want with it. However, opening up an xbox automatically voids the warranty and I can't expect Microsoft to replace mine if it breaks down. You can't mod or jailbreak a product, use it for something it wasn't made for and then expect the company to buy you a new one if you have any problem with it.
