The Cool Breeze of Reality...
So to make a long story short, ive been working on a technology that allows a game (mmo***) to distribute game relevent data (ie your loading into a new level, servers send you all new content within seconds) to users at stupid speeds using the bittorrent protocol. Ive been using a special CDN services, that hosts a shit load of virtual p2p clients in a shit load of data hubs around the US, so i can test my software.
And my isp goes and fucking throttels my damn fucking speed. 20kbs? I can type faster than that!
What the hell's next? Going to start charging me per website now? eh?

May I play devil's advocate here for a sec Bunni?
In the TOS for your ISP, does it specifically state that after a certain amount of bittorrent bandwidth that this protocol will be capped?
If so, and you agreed to this TOS, then they are within their rights. My guess is they made it intentionally vague. Something like "We reserve the right to bandwidth throttle your connection for any reason we may choose at any time we choose".
The real problem is lack of competition. You likely had little choice in an ISP that could meet your bandwidth needs. Cable companies have local monopolies, DSL has limited range and bandwidth, fixed wireless has a laundry list of disadvantages, satellite and cellular technologies are bandwidth limited, and fiber to the premises is available almost nowhere. (ISDN and Dial-up are obviously out)Sleep, eat, conquer, meditate, repeat.

Got some serious sniffers too because they are grabbing the encrypted protocol as well...
Though i forgot to mention it (twas late), this post is more directed toward the approaching powder keg that is so labeled net neutrality.

yea but if it's like this... airplanes overbook... because rarely does everyone show up...
ISP's oversell bandwidth... because rarely does everyone get on at the same time...
Now I'm not saying you shouldn't be able to get all your bandwidth... I'm just saying why :P...
Plus I'm 99% sure it's waaay more complicated than that.
